If You (any party accessing Our Platform is referred to herein as “You” or “Your”) are accessing this website, completing one or more forms for payment through this website, or providing information through our “Contact” form, then this Online Privacy Policy (the, “Policy”) is given to You pursuant to all applicable laws and regulations.  This Policy addresses personally identifiable information collected by Hobby Hour, LLC, an Illinois limited liability company (either “Hobby Hour,” “We,” “Our,” or “Us”) about You when You visit or use this Site.

Hobby Hour and its affiliated companies are committed to protecting the Personal Information (as defined below) entrusted to Us by parties who use Our Platform.  The trust You place in Us when You share Personal Information and/or the Personal Information of another person or entity is a responsibility We take very seriously and is the cornerstone of how We conduct our business.

This Policy informs You of Our policies regarding the collection, use, and disclosure of Personal Information when You use Our Platform and the choices You have associated with that Personal Information. This Policy describes the Personal Information We collect from You and what may happen to that Personal Information and only applies to such personal information. This Policy applies to all pages of the hobbyhour.com domains.

We use Your Personal Information to provide and improve Our Platforms. By using the Service, You agree to the collection and use of Personal Information in accordance with this Policy. Unless otherwise defined in this Policy, terms used in this Policy have the same meanings as in Our Terms of Use Agreement, accessible from hobbyhour.com.

 

Definitions:

Cookies” – Cookies are small pieces of data stored on a User’s device.

Data Controller” – Data Controller means a person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Information is, or is to be, processed. For the purpose of this Policy, We are a Data Controller of Your data.

Data Processor (or Service Providers)” – Data Processor (or Service Provider) means any person (other than an employee of the Data Controller) who processes the data on behalf of the Data Controller.  We may use the services of various Service Providers in order to process Your Personal Information more effectively.

Data Subject” – Data Subject is any living individual who is the subject of Personal Information.

Personal Information” means information that could be used to identify You personally or a person about whom You have provided information (including, but not limited to, Your, name, address, telephone number, email address, or IP address), which has not been previously or subsequently disclosed by You on the public areas of Our Platform or in emails or messages You send to Your Hobby Hour Class.

Usage Data” – Usage Data is data collected automatically, either generated by the use of the Platform or from the Platform infrastructure itself (for example, the duration of a page visit).

User” – The User is the individual using Our Platform. The User corresponds to the Data Subject, who is the subject of Personal Information.

  1. Information Collection:

1.1. We collect the following information about You and Your use of Our Platform in order to create a better, more personalized experience for You:

1.1.1. Your email address, Your name (if provided), Your phone number, Your zip code; and

1.1.2. for each Hobby Hour Class in which You participate, You may choose to submit a short review or statement via email which may be viewed by anyone who is accessing the Platform and Your message board postings, if any.

1.2. We may track certain basic information about Our Users (such as internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, click patterns, etc.). We use this information to do internal research on our Users’ usage patterns, demographics, interests, and general behavior to better understand and serve You and Our other Users.

1.3. We may collect information such as postings You make on the public areas of Our Platform, email messages You send to Us, and correspondence We receive from other Users or third parties about Your activities or postings on Our Platform. Our use of this information is consistent with the rights and restrictions set forth in Section 2.

  1. Use of Information:

2.1. We use the information We collect about you (including Your Personal Information) to create a better, more personalized experience for You based upon Your individual usage habits, improve Our marketing and promotional efforts, analyze site usage, improve Our content and product offerings, and customize Our Platform. These uses improve Our Platform and allows Us to better customize it to meet Your needs. We also use the information We collect about You to resolve disputes, troubleshoot problems, and enforce Our Terms of Use Agreement.

2.2. We may compile information We collect about You and use it, in an aggregate form only, in the negotiation and establishment of service agreements with public and/or private enterprises under which such enterprises will serve as Our partners or as venues for meetings between Our Users.

2.3. We may use Your: a) correspondence with Us; b) photographs submitted for publication on Our Platform, be it via email, postings on Our Platform, social media accounts (e.g., Twitter, Instagram, Facebook, YouTube, or Pinterest); or c) feedback via the User polls, for promotional sales, or any use We deem appropriate. Our use of such materials is consistent with the restrictions on disclosure of Personal Information set forth in Section 3.

  1. Information Collection & Use:

We collect several different types of information for various purposes to provide and improve Our Platform.

3.1 While using Our Platform We may ask You to provide us with certain Personal Information that can be used to contact or identify You. We may use Your Personal Information to contact You with newsletters, marketing or promotional materials, and other materials We believe may be of interest to You. You may opt out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send to opt-out or adjust your settings.

3.2 We may also collect information about how Your Usage Data. This Usage Data may include information such as Your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of Our Platform that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

3.3 We may use and store information about Your location, if You give us permission to do so (“Location Data”). We use Location Data to provide features of Our Platform and to improve and customize Our Platform. You may be able to enable or disable Location Data when You use Our Platform through Your device settings.

3.4 We use cookies and similar tracking technologies to track activity on Our Platform and to hold certain information. Cookies are files with small amounts of data that may include an anonymous unique identifier. Cookies are sent to Your browser from a website and stored on Your device. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Platform. You may be able to set Your browser to refuse all cookies or to provide notice when a cookie is being sent. If You do not accept cookies, then You may not be able to use all parts of Our Platform. Session Cookies. We use Session Cookies to operate Our Platform.

Security Cookies. We use Security Cookies for security purposes.

3.5 We use the data We collect for various purposes, including to:

provide and maintain Our Platform

notify You about changes to Our Platform

allow You to participate in the interactive features of Our Platform You choose

gather analysis or valuable information so that We can improve Our Platform

monitor the usage of Our Platform

detect, prevent and address technical issues

provide You with news, special offers and general information about other goods, services and events which We offer that are similar to those that You have already purchased or enquired about unless You have opted not to receive such information.

3.6 We will retain Your Personal Information only for as long as is necessary for the purposes set forth in this Policy. We will retain and use Your Personal Information to the extent necessary to comply with Our legal obligations (for example, if we are required to retain Your Personal Information to comply with applicable laws or regulations), resolve disputes, or enforce Our legal agreements and policies. We will also retain Usage Data for internal analysis purposes. Usage Data is retained, inter alia, for a shorter period of time, except when Usage Data is used to strengthen the security or to improve the functionality of Our Platform or We are legally obligated to retain this Usage Data for longer periods of time.

3.7 Your information, including Your Personal Information, may be transferred to, and maintained on, computers located outside of Your state, province, country or other governmental jurisdiction of domicile where data protection laws may differ than those from Your domicile. If You are located outside of the United States of America and choose to provide information to Us, then please note that We transfer the data, including Your Personal Information, to a location within the United States of America and process it there. Your use of Our Platform represents Your agreement to this transfer. We will take all commercially reasonable steps to ensure that Your Personal Information is treated securely and in accordance with this Policy.

  1. Disclosure of Data:

4.1. Aggregated information that We may share with Our marketing partners includes, but is not limited to, information showing the relative popularity of one Hobby Hour venue over another or the popularity of certain Hobby Hour Classes.

4.2. You should understand that any information You provide through the registration process or post to the public areas of Our Platform or through the use of Our Platform (including your name (if provided) and location information) may be accessible by and made public through syndication programs and by search engines, metasearch tools, crawlers, meta-crawlers, and similar programs.

4.3. Though We make every effort to preserve Your privacy, We may need to disclose Your Personal Information when required by law or if We have a good-faith belief that such action is necessary to:

(a) comply with a current judicial proceeding, a court order or legal process served on Us;

(b) enforce this Policy or Our Terms of Use Agreement;

(c) respond to claims that Your Personal Information violates the rights of third-parties; or

(d) protect the rights, property, or personal safety of Hobby Hour, its Users, or the public.

By using Our Platform, You authorize Us to disclose any Personal Information about You to law enforcement or other government officials as We, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose Us or You to legal liability.

4.4 The security of Your Personal Information is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect your Personal Information, We cannot and do not guarantee its absolute security.

4.5 We do not support Do Not Track (“DNT”). DNT is a preference You may set on Your web browser to inform websites that You do not want to be tracked.

  1. Your Rights:

Hobby Hour aims to take commercially reasonable steps to allow You to correct, amend, delete, or limit the use of Your Personal Information. You may update Your Personal Information directly within Your account settings section. If You are unable to change Your Personal Information, please contact Us to make the required changes. If You wish to be informed what Personal Information We hold about You and want it to be removed from Our systems, then please contact Us. In certain circumstances, You have the right to:

access and receive a copy of the Personal Information We hold about You;

modify any Personal Information held about You that is inaccurate; and

request the deletion of Personal Information held about You, but only upon Your cessation of use of Our Platform.  Re-use of the Platform will necessitate collection of Your Personal Information.

 

  1. Service Providers:

We may employ third-parties to facilitate Our Platform (“Service Providers”), to provide services on Our behalf, to perform related services or to assist Us in analyzing how Our Platform is used. These third-parties may have access to Your Personal Information, but only to perform tasks on Our behalf and are obligated not to disclose or use such Personal Information for any other purpose.

  1. Payments:

We may provide paid products and/or services through Our Platform. In that case, We use third-party services for payment processing (e.g., payment processors). We will not store or collect Your payment details. Your payment information is provided directly to Our third-party payment processors whose use of the information You provide to them is governed by their privacy policy.

  1. Links To Other Sites:

Our Platform may contain links to other sites that are not operated by Us. If You click on a third-party link, You will be directed to that third-party’s site. We strongly advise You to review the privacy policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or their services.

  1. Children’s Privacy

We do not authorize the use of Our Platform by anyone under the age of 13 (“Children” or “Child”). We do not knowingly collect Personal Information from anyone under the age of 13. If You are a parent or guardian and You are aware that your Child or Children have provided Us with Personal Information, please contact Us. If We become aware that We have collected Personal Information from a Child or Children without verification of parental consent, We will take steps to remove that information from Our servers.

  1. Communications from Hobby Hour and Users of the Hobby HOur Platform:

All communication by and between Users through Our Platform may be monitored by Hobby Hour internally to protect Our commercial interests and confirm User communication adheres to Our Terms of Use Agreement.

  1. Reviewing, Updating, Deleting and Deactivating Personal Information:

After registration on Our Platform for participating in or teaching Hobby Hour Classes, We provide a way to update Your Personal Information. Upon Your request, We will deactivate Your account and remove Your Personal Information from Our active databases. To make this request, email: help@hobbyhour.com. Upon Our receipt of Your request, We will deactivate Your account and remove Your Personal Information as soon as reasonably possible in accordance with Our deactivation policy and applicable law. Nonetheless, We will retain in Our files information You may have requested Us to remove if, in Our discretion, retention of the information is necessary to resolve disputes, troubleshoot problems, or to enforce the Terms of Use Agreement. Furthermore, Your information is never completely removed from Our databases due to technical and legal constraints (for example, We will not remove Your information from Our back up storage).

  1. Notification of Changes:

We may change, modify or replace this Policy at any time with or without notice.  It is Your obligation to remain current as to Our privacy policies by reviewing this Policy each time You use Our Platform.

  1. Dispute Resolution:

Any dispute, claim or controversy arising out of or relating to this Policy or previous Privacy Policy statements shall be resolved through negotiation, mediation and arbitration as provided under Our Terms of Use Agreement.
